Supreme Court Judge Strength Increased from 33 to 37

The President of India has promulgated the Supreme Court (Number of Judges) Amendment Ordinance, 2026, increasing the sanctioned strength of Supreme Court judges from 33 to 37, excluding the Chief Justice of India (CJI).

What does this mean?

  • Earlier sanctioned strength:
    • 1 Chief Justice of India + 33 judges = 34
  • New sanctioned strength:
    • 1 Chief Justice of India + 37 judges = 38

Thus, the Supreme Court gets 4 additional judge posts.

Why was this increase needed?

The move comes amid:

  • Rising judicial pendency
  • Increasing constitutional and commercial litigation
  • Greater workload on Constitution Benches
  • Need for faster disposal of cases

  • Parliament determines the number of Supreme Court judges through legislation.
  • Since Parliament was not in session, the government used the Ordinance-making power under Article 123.
